Terms & Conditions, Food Safety Disclaimer & Limitation of Liability

These Terms & Conditions (“Terms”) apply to all orders, purchases, subscriptions, deliveries, pickups, and services provided by Shukrana Cuisine (“Shukrana,” “we,” “us,” or “our”) through our website, ordering platforms, forms, text messages, telephone orders, social media, or any other method.

By placing an order, purchasing food, creating an account, subscribing to a meal plan, accepting delivery, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms.

1. Our Services

Shukrana Cuisine provides prepared food, meal services, delivery services, and related food products.

Depending on the particular product or order, Shukrana Cuisine may operate as a food preparer, retailer, reseller, distributor, delivery provider, or marketplace.

Some food may be prepared directly by Shukrana Cuisine. At other times, Shukrana Cuisine may purchase, source, distribute, deliver, or resell food prepared or packaged by independent restaurants, caterers, commercial kitchens, manufacturers, suppliers, or other food-service businesses (“Third-Party Providers”).

Customers acknowledge that not every product offered or delivered by Shukrana Cuisine is necessarily prepared by Shukrana Cuisine.

2. Third-Party Restaurants & Resold Food

When Shukrana Cuisine sells or delivers food prepared by a Third-Party Provider, the Third-Party Provider is responsible for its own food preparation practices, recipes, ingredients, sanitation procedures, cooking methods, allergen controls, packaging, and other activities under its control.

Ingredient descriptions, allergen information, dietary classifications, nutritional information, and other information regarding third-party products may be based upon information provided to Shukrana Cuisine by the applicable Third-Party Provider.

Shukrana Cuisine cannot independently guarantee the accuracy or completeness of all information supplied by a Third-Party Provider.

To the maximum extent permitted by applicable law, Shukrana Cuisine shall not be responsible for the independent acts, omissions, representations, preparation practices, ingredient substitutions, sanitation practices, or allergen controls of Third-Party Providers.

Nothing in these Terms excludes liability that cannot legally be excluded.

3. Vegetarian Food

Shukrana Cuisine specializes in vegetarian food. However, certain products may be prepared, manufactured, stored, transported, or packaged in shared commercial kitchens, restaurants, manufacturing facilities, warehouses, vehicles, or other facilities that may also handle non-vegetarian products or allergens.

Unless expressly stated otherwise for a particular product, the term “vegetarian” describes the intended ingredients of the product and should not be interpreted as a guarantee against incidental cross-contact occurring at a third-party or shared facility.

Customers requiring food prepared under specific religious, medical, allergen-free, or cross-contact-free standards should contact Shukrana Cuisine before ordering.

4. Food Allergies & Dietary Restrictions

IMPORTANT ALLERGY NOTICE: Food offered through Shukrana Cuisine may contain or come into contact with common allergens, including but not limited to milk/dairy, wheat/gluten, peanuts, tree nuts, soy, sesame, eggs, and other allergens.

Food may be prepared in facilities that process or handle allergens.

Shukrana Cuisine does not guarantee an allergen-free environment unless such a guarantee is expressly provided in writing for a particular product.

Customers are responsible for informing us of allergies and dietary restrictions before ordering and for determining whether a product is appropriate for themselves or anyone to whom they provide the food.

If you or the intended consumer has a severe or life-threatening food allergy, you should not rely solely upon menu descriptions, photographs, product names, website information, or verbal representations. Please contact us before ordering so that available ingredient and preparation information can be discussed.

5. Ingredients & Menu Information

We make reasonable efforts to provide accurate menu and ingredient information.

However, recipes, suppliers, brands, ingredients, portions, preparation methods, and product availability may change from time to time.

Third-Party Providers may also make substitutions or changes without advance notice to Shukrana Cuisine.

Photographs and menu images are illustrative. The appearance, portion, presentation, ingredients, or packaging of the actual product may vary.

6. Customer Responsibility After Delivery

Customers are responsible for the proper handling of food after delivery or pickup.

This includes appropriate:

* refrigeration;
* freezing;
* storage;
* reheating;
* handling;
* protection from contamination; and
* timely consumption.

Perishable food should be refrigerated or otherwise stored according to applicable food-safety guidance promptly after receipt.

Shukrana Cuisine cannot control food once it has been delivered, picked up, left at the customer’s designated location, or otherwise transferred to the customer.

To the maximum extent permitted by law, Shukrana Cuisine is not responsible for illness, spoilage, contamination, deterioration, or other harm resulting from improper storage, handling, reheating, delayed refrigeration, extended exposure to unsafe temperatures, or consumption after delivery when the condition was caused after the food left our control.

7. Unattended Deliveries

By requesting delivery, customers authorize Shukrana Cuisine and its delivery providers to leave an order at the address or location provided when appropriate.

This may include a front door, lobby, reception area, concierge desk, mailroom, designated food-delivery area, or another reasonably accessible location.

Once an order has been delivered to the customer’s requested or reasonably appropriate delivery location, responsibility for promptly retrieving and properly storing the food transfers to the customer.

Customers should make arrangements to retrieve perishable food promptly.

8. Delivery Times

Any delivery window or estimated delivery time is an estimate and not a guarantee, unless expressly stated otherwise.

Delivery may be affected by traffic, weather, road conditions, vehicle problems, building access, security procedures, incorrect addresses, customer availability, order volume, emergencies, government restrictions, or circumstances outside our reasonable control.

A reasonable delivery delay does not automatically entitle the customer to a refund.

9. Incorrect Addresses & Access Problems

Customers are responsible for providing a complete and accurate delivery address, apartment or suite number, gate code, access instructions, telephone number, and other information reasonably necessary to complete delivery.

Shukrana Cuisine is not responsible for failed or delayed deliveries resulting from incorrect or incomplete information supplied by the customer or from circumstances preventing reasonable access to the delivery location.

Additional redelivery charges may apply where appropriate.

10. Order Accuracy

Customers are responsible for reviewing their orders before submission.

If you receive an incorrect or materially damaged item, please contact Shukrana Cuisine as soon as reasonably possible and provide information or photographs reasonably necessary for us to investigate the issue.

Depending on the circumstances, Shukrana Cuisine may provide a replacement, credit, partial refund, or full refund.

The appropriate remedy will depend upon the circumstances and applicable law.

11. Cancellations & Refunds

Because food is perishable and may be prepared or purchased specifically for an order, cancellations may not be accepted after the applicable order cutoff or after preparation or procurement has begun.

Refunds, credits, or replacements will be evaluated according to the circumstances, our posted refund/cancellation policy, and applicable law.

Nothing in these Terms eliminates any refund or remedy that a customer is legally entitled to receive.

12. Subscriptions & Recurring Orders

If Shukrana Cuisine offers subscriptions or recurring meal plans, the applicable price, frequency, billing terms, cancellation process, and renewal terms presented at enrollment will apply.

Customers are responsible for managing their subscription before the applicable cutoff.

Any recurring charges will be made only in accordance with the authorization and disclosures provided during enrollment and applicable law.

13. Food Provided to Other People

Customers may purchase meals for family members, employees, guests, or other individuals.

The person placing the order is responsible for communicating relevant ingredient, allergen, storage, reheating, and food-safety information to the ultimate consumer.

A purchaser should never represent a Shukrana Cuisine product as allergen-free or suitable for a particular medical condition unless Shukrana Cuisine has expressly provided that representation in writing.

14. Resale & Commercial Redistribution by Customers

Unless expressly authorized by Shukrana Cuisine, customers may not commercially resell, repackage, relabel, modify, or redistribute Shukrana Cuisine products as their own products.

Shukrana Cuisine is not responsible for claims arising from unauthorized resale, alteration, relabeling, improper transportation, improper storage, or redistribution occurring after the product has left Shukrana Cuisine’s control, except to the extent liability cannot legally be excluded.

15. Assumption of Ordinary Food-Related Risks

Customers acknowledge that prepared and delivered foods involve inherent risks associated with transportation, storage, handling, ingredients, allergens, and individual sensitivities.

Customers are responsible for determining whether particular foods are appropriate for their personal dietary requirements.

This provision does not require a customer to assume risks created by conduct for which liability cannot legally be waived under applicable law.

16. Third-Party Delivery & Service Providers

Shukrana Cuisine may use employees, independent contractors, delivery companies, payment processors, ordering platforms, technology providers, restaurants, commercial kitchens, or other third parties to fulfill orders and provide services.

To the extent permitted by law, Shukrana Cuisine is not responsible for independent acts or omissions of third parties that are outside Shukrana Cuisine’s reasonable control.

17. Force Majeure & Events Outside Our Control

Shukrana Cuisine will not be responsible for delays or inability to perform caused by circumstances reasonably outside our control, including severe weather, natural disasters, road closures, government actions, power outages, internet or telecommunications failures, labor disruptions, supplier shortages, transportation failures, emergencies, or similar events.

Where practical, we will make reasonable efforts to communicate significant disruptions.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHUKRANA CUISINE AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OUR SERVICES OR PRODUCTS.

To the extent permitted by law, any limitation stated in these Terms applies only where legally enforceable.

Nothing in these Terms is intended to disclaim, waive, or limit liability that cannot lawfully be disclaimed, waived, or limited, including any liability arising from conduct for which Washington or other applicable law prohibits contractual limitation.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Shukrana Cuisine and its owners, employees, contractors, and agents from third-party claims, losses, damages, liabilities, and reasonable costs arising from your:

* unauthorized resale or redistribution of products;
* alteration, relabeling, or repackaging of products;
* improper storage or handling after delivery;
* provision of materially inaccurate delivery or order information;
* misuse of our services; or
* violation of these Terms.

This provision does not require a customer to indemnify Shukrana Cuisine for Shukrana Cuisine’s own liability where such indemnification is prohibited by law.

20. No Medical or Nutritional Advice

Menu descriptions, nutritional information, ingredient information, and communications from Shukrana Cuisine are provided for general informational purposes and are not medical advice.

Customers with medical conditions, severe allergies, pregnancy-related dietary concerns, or medically prescribed diets should consult an appropriate healthcare professional regarding their individual dietary needs.

21. Website & Technology

We make reasonable efforts to keep our website and ordering systems accurate and available, but uninterrupted or error-free operation cannot be guaranteed.

Pricing errors, technical errors, availability errors, or obvious typographical mistakes may be corrected when discovered, subject to applicable consumer-protection laws.

22. Fraud & Abuse

Shukrana Cuisine reserves the right, subject to applicable law, to refuse or cancel orders reasonably suspected of fraud, payment abuse, unauthorized commercial resale, threats to employees or drivers, misuse of promotions, or other unlawful or abusive conduct.

23. Governing Law

These Terms shall be governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where another jurisdiction’s law is required to apply.

24. Disputes

Before initiating formal legal proceedings, customers and Shukrana Cuisine are encouraged to make a good-faith attempt to resolve disputes directly.

Nothing in this provision prevents either party from exercising rights or remedies available under applicable law.

25. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent legally permissible, and the remaining provisions shall remain in effect.

26. No Waiver

Failure by Shukrana Cuisine to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or our right to enforce it in the future.

27. Changes to These Terms

Shukrana Cuisine may update these Terms from time to time.

The version posted at the time an order is placed will generally govern that transaction unless applicable law requires otherwise.

28. Acceptance of Terms

By placing an order with Shukrana Cuisine, you acknowledge that you have had an opportunity to review these Terms and agree to be bound by them.

Where our ordering system presents an acceptance checkbox, customers may be required to affirm:

“I have read and agree to Shukrana Cuisine’s Terms & Conditions, including the Food Allergy, Third-Party Food, Delivery, Food Safety, and Limitation of Liability provisions.”
